Are Vaccine Mandates Creating a Class System in the Workplace?

As we are nearing 2020, it’s a fair question to check in on how close the nation is to reaching the targets set by Healthy People 2020. Perhaps the more important question is how these goals may be creating a discriminatory class system separating the vaccinated versus the unvaccinated in the workplace.

Many consider the workplace mandate for annual influenza vaccinations the most disturbing piece of the Healthy People 2020 agenda. The objective calls for mandatory flu shots as a condition of employment among 90% of health care workers.

The Centers for Medicare and Medicaid Services implemented a final rule requiring hospitals to report vaccination rates, tying these rates to Medicare reimbursement.1  Additionally, the U.S. Department of Health and Human Services’ National Vaccine Advisory Committee approved recommendations urging health care facilities to consider mandatory flu vaccination policies as a condition of employment.2 

Despite federal actions, many high-profile groups representing health care workers continue to be divided on flu vaccine mandates. The National Nurses Union, the largest nurses union in the country, for example, publicly oppose mandatory vaccinations for health care workers,3  while the American Nurses Association regularly speaks out in support.4 

But the division does not stop the bullying and humiliation tactics used nationwide. to discriminate against health care workers declining to get influenza vaccine, a vaccine that for the past three flu seasons federal health officials admit has had an effectiveness rate of at best 47% to 62%.5  In addition, influenza vaccine-related injuries and deaths are the number one most compensated vaccine injury claim for adults in the federal vaccine injury compensation program (VICP).6 

Just Shy of a Full-Scale National Flu Vaccine Mandate

What started as small steps has evolved into a full-on war on autonomy, personal and religious freedoms and protection of bodily integrity.

Overall, 13 states require or recommend an annual flu shot for workers in hospital and other medical settings. California was the first state to require hospitals to offer free flu vaccines to all employees and require those who decline to sign a form stating their refusal.7  In 2013, Rhode Island became the first state to implement one of the tougher mandatory flu vaccines for health care personnel. During periods deemed as “widespread flu outbreak,” individuals must receive a flu vaccine or face citations of “unprofessional conduct” against their license and a $100 fine.8 

The heavy-handed approach from federal agencies and states has trickled down to individual policies in the medical settings. In 2005, only a few hospitals mandated flu vaccines across the country. The number grew to more than 400 in 2011.9 

During the 2014-15 influenza season, 40.1% of health care personnel reported a requirement from their employer to receive the flu vaccine, according to a nonrandom Internet survey including 1,914 individuals. The requirement was most common in the hospital setting (64.8%) and least common in the long-term care setting (26%). Conversely, during the 2011-12 flu season, only 20.9% of health care professionals reported such a mandate from their employer.10 

Hundreds of workers have been fired nationwide for opting out of the flu vaccination when their employer required inoculation. In 2012, TriHealth, the largest employer in Cincinnati, Ohio, terminated 150 employees who did not comply with their flu vaccine mandate.11 

Christiana Care Health System, the largest private employer in Delaware, pins workers with “I’m vaccinated” badges to outcast unvaccinated workers. Vaccinated workers also receive credit toward an annual bonus, while those who opt out of vaccination must wear face masks during any patient interaction.12 

Kaiser Permanente incorporated a flu vaccination policy into its three-year agreement with the Coalition of Kaiser Permanente Unions. The agreement, which went into effect October 1, 2015, mandates free seasonal flu vaccination for the 105,000 Kaiser Permanente workers in seven states and the District of Columbia represented by the hospital unions. Unvaccinated workers must sign a refusal form and are required to wear a surgical face mask during flu season while working in patient care areas.13 

Workers Left Without a Choice

It is very apparent these strong-arm tactics have gone a long way to bully many health care workers into getting annual flu shots.

The CDC has reported an increase the rate of flu vaccination among health care personnel year after year. According to their 2015 online survey, 77.3% reported receiving the influenza vaccine during the 2014-15 season.14  In comparison, vaccination rates among health care workers more than a decade earlier  were as low as 35.8% according to 2000 National Health Interview Survey data on 1,651 health care workers.15 

The problem with this—besides the fact that people are being stripped of their most basic informed consent rights—is that there may be no impact from the mandates because there comes a point when there is no real return on preventing influenza in the workplace by requiring flu shots for all employees.

Limited Effect of Vaccination on Influenza Incidence Rates

A September 2015 retrospective study revealed that once health care worker vaccination rates plateau and reach 50% in the workplace, there is no further drop in influenza rates. The study assessed the nosocomial influenza rate during five flu seasons at the University of New Mexico Health Sciences Center in relation to vaccination rates among the center’s health care personnel. Researchers reviewed rates of influenza (defined as infections diagnosed at least 48 hours after hospital admission for influenza-like illness) from 2010 to 2015. Overall, there were 523 admissions with a confirmed influenza diagnosis.

Also during this time period, rates of vaccination increased from 47% to 96%. However, analysis revealed that despite an initial decrease in influenza rates from 9% to 4.9% during the first year, subsequent seasons showed no additional decrease in infections (4.3%, 5.2% and 5.1%, respectively). Overall, the decrease in influenza rates from the first to the final season was deemed non-significant.16 

“It’s not that we should stop vaccinating,” study researcher Brandon Dionne told Medscape, “but we should be focusing on other interventions … like hand-washing.” He added, “At a certain point, you don’t have a real return on vaccination for reducing nosocomial flu.”17

    Another example of how ridiculous a mandatory flu shot is for hospital workers is the fact the public/visitors roam freely in/out of patient’s rooms. Where’s their flu shot? But, the patient needs protection from us?? This is money driven and slow extermination at it’s finest.

    Groups like the NVIC should have activist linking capability. There should be a lawyer for every state in the union, lined up by NVIC, just standing by for class action complaints and new citizen registrants. News is one thing, but action is something else. NVIC should shift focus from micro managing what they can, to macro managing this whole thing, with more points of entry for every day persons. If there was a class action we could have joined with through a trusted source like NVIC, we would have already done so. / Update for Kaiser; Even members who have gotten the flue shot, are removing the ridiculous stickers from their badges or x’ing them out as a sign of resistance. Flue shot was so ineffective this year, and also unusually damaging somehow, that more workers than ever are saying they won’t get it next year. The workers union has remained silent, and has refused to stand up for the rights of the union worker members.

    I lost 2 jobs at my hospital because of the flu shot mandate, and they allow for religious and medical exemptions. I applied 2 times for religious exemptions but they denied me. I have filed 2 EEOC complaints which are still being investigated. More people need to file them, since they are discriminatory. Even if you were not hired because of the flu shot, file a complaint. If more people do this, perhaps we can help shift the tide. I am waiting for the EEOC to move on my case, but feel pretty confident that they will since it is 3 years old and they haven’t thrown it out yet…..The fact that they allow for religious exemptions, but have denied me saying my beliefs are not religious is really bad for them. I have worked at this hospital for 18 years, and claimed a religious exemption to the shot for 15 years before the mandate.

    I also work in the health field, and luckily, have never been forced a flu vaccination. One of my ‘tricks’ is telling a bold face lie because I would rather remain vaccination free than be fired. I tell my employer that, unfortunately, both my grandmother and my cousin were diagnosed with Guilliam-Barre after receiving a flu shot, and therefore I could never take the risk since there may be a genetic component to this disease. It’s really sad that a person has to be dishonest just to be able to choose wisely.

    Look at the positive side. With people wearing those badges, at least we’ll know who to avoid. They’ll be the ones shedding viruses and getting the rest of us sick.

    Not only offered, but in many cases forced upon the unwilling.
    One should wonder why is this happening? What is the real agenda?
    But the more important question could be what is “Healthy People 2020″?

    At my hospital “All team members” are mandated to get the flu vaccine or leave the employment. A “non-compliance with policy list” has come out of individuals who still need the vaccine by the upcoming deadline. Where is the non-compliance list for the doctors? Even those who are not employed with the hospital are still considered team members as they are there everyday making their livelihood and working with many more patients and others than I ever will. Last year they were excused. This modern day bullying to threaten people’s livelihood may be legal but it is not moral. The lack of consistency with the doctors shows the hypocrisy. The lack of knowledge and integrity by hospital leaders is more than disappointing.

      Looks like it’s past time for you to make the $100 nvic donation, and then spread some of those free books around the office. Flyer the parking lot. Take a stand now. Contact senior persons at NVIC and see if they could advise you regarding unfair termination lawsuit and representation. You’ll be taken more seriously in your resistance to these illegal mandates, if you have representation ahead of time. And ‘legal’ is relevant. You have liberty, guaranteed by the constitution. Anything less is uncivilized, and also arguably illegal. Do not refer to something which is supposed to be illegal, as being legal. As the old saying goes; When injustice becomes law, resistance becomes duty.

    I’m a physician who refuses flu shots, so I’m forced to wear a surgical mask when seeing patients in the hospital. Few people really know what’s going on behind the scenes. For most vaccinations, the cost of research and development is prohibitive, so mandatory vaccination plus exclusion from liability is the only way they can recoup those costs. One scientist I know of who develops vaccines does not have any of his children vaccinated. What does that tell you? (Interestingly 75% of doctors surveyed would never have chemo or radiation for cancer in themselves or a family member. Again, a huge double standard.) Even the FDA admits that vaccines are contaminated with RNA and DNA fragments, prions, and other viruses. The risks outweigh the benefits for those who are proactive in their health. There are more efficacious alternatives to the flu vaccine documented in the medical literature. One such intervention is prolin-rich polypeptide extract from Bovine colostrum. 3 sprays in the back of the throat twice a day during flu season is not only anti-viral, but anti-bacterial as well. We have right now in this country elements of medical fascism, and I’m surprised that no law suits have been filed to protect our freedoms.

      So, where you work, doctors are allowed to refuse shots (for now) and have to wear a mask…is that the same policy with lower paid workers? Or are they presented with a ‘shot or get fired’ ultimatum? If the latter, that is some glaring hypocrisy…. Why not just have those who don’t want them just wear masks?

      Most MD’s know more about what’s going on, but refuse to tell their patients. The power that is being given MD’s via our government is truly frightening.

      It’s cost prohibitive to go against these major corporations, and the corporations know that. Please allow me to add a powerful new ideal to your existing repertoire, ‘Fines based on income’. Thereby financially incentivizing the proper legal balance against corporate criminality. Only when the fine can take a meaningful bite out of the profits, with a proportional compensation for prosecuting lawyers, can suits like you speak of come forward, in this industry, and a variety of other industries as well. Without being able to claim a portion of that unjustly earned corporate profit, any hopeful prosecution or investigative action will be immediately hampered and subsequently eliminated, by squads of corporate and biased lawyers whom beat the opposition through attrition, paperwork, and infinite legal fees. Nobody dares start up a lawsuit, because by the time it’s all said and done, the litigants will have gone broke, and then will be in debt as the defendant will win on damages. The defendants will successfully suppress everything, and the court case will never see the light of day, because risk vs gain for prosecution is infinite risk and finite gain, with substantial imbalance in the available funds of prosecution vs defense. In the absence of some sort of miraculous Erin Brockovich scenario or someone along those lines, the only solution left would be fines based on income. Fines based on income would remedy this corporate loophole and bring forth a whole new check to the balance, from the private legal community. Don’t hold your breath for effective legal relief, until the mechanisms which provide that check to the balance, are corrected to fit these modern times.

    We are watching bully-ish tactics by the pharmaceutical industry – and nobody seems to be seeing through the baloney! Doctors cave because they get more business and hate to say not to the industry6 that brings them free lunch (literally) and whom they have to trust with a lot f information that they do not have time to find out for themselves.
    But really: if I do not get a shot but you do – then theoretically you have absolutely no risk from me. So the ones who feel they need protection of course should be vaccinated – otherwise, why should healthy folks be required to be vaccinated if the at risk or weaker ones are REALLY protected! Illogical.

      Please focus on educational institutions. We had a 5 year plan to boost to registered nurse, but as we refuse vaccinations, we cannot acquire that education. This changes our entire game plan for career advancement. Schools should not be allowed to operate as medical service advisors, and force student vaccinations. Next time you hear any news about lack of medical professionals in any given field, you’ll know why. The medical industry is turning away the best and brightest and most critical minded people, but partnering with educators whom force vaccinations as a requirement of schooling. Could not find a single educational institution in CO, which offered RN programs, and did not also force vaccinations.

    I am a healthcare worker and I just turned down a job offer for a hospital contract paying $1800 a week because they force the flu and whooping cough vaccines. They won’t accept a religious waiver. It’s absolutely ridiculous that I don’t have a right to say I don’t want a toxic and ineffective solutions injected into my body. I say I turned the job down but honestly they said they would not hire me unless I got the flu vaccine and I said no. I asked if I had to sign a waiver letting them out of obligations to pay for everything for me and my life if the flu vaccine damages its me and yes I have to find a waiver leting them off the hook. so I said who’s going to take care of me and my child if this gives me guilliam Barre and I’m paralyzed or anything else for my life. really no one. I have to go through the horrible process of trying to prove the vaccine did it which is very daunting and most likely they will say the vaccine didn’t do it. How is this foced toxic solution able to be legal against people for employment. How is that legal. Why are so many people allowing this to happen and people putting up with it. If every healthcare worker in the country refused a job or said they’re not coming into the hospital tomorrow because they’re not getting the flu vaccine this wouldn’t be happening but nobody wants to stand up.

      It makes you wonder, they’re trying to force you to get two vaccines. What’s it going to be next year, 3 vaccines? And then all of them? When will they stop? Or more like will they even stop?

      I guess it’ll look pretty bad for them when all these vaccinated ‘health care’ professionals are all out sick with the flu, or measles, or other problems (like sudden death, blood in urine, etc).

        The Disney False Flag (almost 1 year ago) was the launch of the rabid state to state submitting of bills to change vaccine exemption laws in the US.

A group of Oregonians decided to investigate the forces & money involved in their fight to defeat the passage Senate Bill 442, removal of parental rights and mandatory vaccination for children in Oregon. What they found was a long term plan implemented by NAACHO. After looking at NACCHO’s financial records it was discovered it’s a front group funded by the CDC. In essence, it’s a lobbying group.         In July 2011 NACCHO issued a very clear policy statement that the time had come for states to eliminate personal belief exemptions: In July 2013, NACCHO’s Board approved this new policy statement, titled “An Immunization Program for all Stages of Life”. It included ways to work in conjunction by lobbying heavily state legislators to remove all exemptions-medical, religious and philosophical. In the body of their policy statement is the following:

        “the creation of a comprehensive national immunization program that addresses all stages of life (CRADLE to GRAVE) with the intention of achieving the Healthy People 2020 immunization goals and standards”.

        Healthy People 2020 goal is the implementation of the U.S. National Adult Immunization Plan.

        After completion of the childhood vaccinations what will kick in at age 19 is the Adult immunization plan:

          I think when the Democrats stop voting for this type of oppressive, anti-choice compulsory vaccine legislation that eliminates exemptions! Though I don’t reside in California (I live in a neighboring state that just “narrowingly” voted down compulsory legislation recently), I’ve looked into the party breakdown of the passing of that disastrous SB277. And whatta ya know? 44 Democrats voted yea and ONLY 5 voted no! Only 2 Republicans voted yes in the 46-31 passage of the final vote:

          Yes…we have all this brewing legislation nationwide that attempts to eliminate/restrict vaccines exemptions. But before we start always blaming big pharma, the CDC, Bill Gates, etc., “the buck stops” with our legislators. With SB277, it wasn’t like the bill passed 77-0, and therefore, a “slam dunk” with no hope. There were 26 Republicans who must believe in individual rights and choice while 44 Democrats must feel the need to basically force vax the kids, and therefore removing that choice from the parents.

          Again, I don’t reside in CA, so I didn’t follow the floor debate on the bill. However, does Sen. Pan (D), who orchestrated the bill, have that much mind control over his fellow Dems??? (Again, ONLY 2 Republicans fell for his act). Perhaps, if CA had a Republican Governor maybe the bill would have been vetoed (fat chance that Gov. Brown was going to break party lines and veto the bill). So just like big pharma and the CDC are the “bad guys” in this national push for compulsory vaccination, so are the Democrats in this particular case.

          I know politics bring out the worse in people, and it becomes no different than the passionate devotion to a favorite sports team. But in this case, it seems crystal clear that the Democratic party of the California Senate let down the pro-choice believing people of CA. If more Democrats would have voted no on this bill, it wouldn’t have passed and we would all be celebrating a major victory for the pro-choice and individual rights to decline immunization without consequences.

          Like I said, “the buck stops” with our legislators! ?

      These actions have become institutionalized, through workplace mandates and educational mandates. My wife recently looked into registered nurses programs, and we could not find any schooling programs, where the school itself was not mandating all of the recommended shots. These days, if you don’t comply with vaccinations, you can’t even get entry into the industry. As much focus should be on educational institutions as well as employers, because the mandates at schools has all but eliminated future work place resistance from newcomers.

    Kaiser in Colorado put forth this must wear a mask policy. Complete with propaganda pamphlet instructing workers how to unwittingly lie to patients about vaccine safety. They’re probably going to think twice when the bills for all those extra boxes of masks and gloves continue on to infinity, and worker productivity which they’re so focused on, suffers as a result. In the same week, Kaiser pulled back on all this office product and supply ordering, claiming it must save money. Then in the same week, they ordered all workers whom did not take the flue shot to gear up. This is office place discrimination and the local Kaiser union has seriously disappointed and betrayed their own union members, by capitulating to these mandatory vaccine policies. As soon as flue vaccines are actually mandatory for employment, my wife will have to transfer or find a new employer. These policies are going to change and shift her entire life long career choices, because vaccination is simply not an option. Where is our union representation? REQUESTING HELP FROM THE KAISER UNION(S), to protect workers rights, like they’re supposed to be doing anyways. My wifes co worker got the flue shot and immediately came down with something serious and lost her voice for a week and had to call in several days. With aggressive new handling of vaccine mandates, and increasingly ineffective vaccines with increasing side effects, comes with it a tidal wave of worker resistance. As more workers say because of negative side effects, they won’t be getting the flue shot next year. It is a good idea though to wear masks around vaccinated persons, if you’re unvaccinated. It’s the people whom get the shots, whom always get sick. The properly implemented policy is for everyone whom gets the shot, to wear a mask for the next month, everywhere they go to protect the patients whom do not willingly expose themselves to dangerous pathogens. It’s so sad to see the patients line up for free flue shots. They wait in line bright and cheerful, then walk out pale and sickly looking, immediately after getting the shot. I watched a young child desperately resist, and nobody respected that young persons right to choose. It was quite cruel, and they stabbed him in the arm anyways. Boy must have been 6 years old. The children don’t know why per say, but their own physiological systems tell them no, and they resist the shots, based on how awful they felt last time they got them. Unlike adults, children often are more in tune with the needs and responses to their bodies. I see all these cross eyed and retarded kids with shocked parents at the doctors office, and it’s so sad to think they could have all been healthy, in the absence of big pharma ‘vaccines’. Request from NVIC: Activist stickers please. 2nd request: Acquire these shots, test them for toxins, and mail toxicology results to the unions.

    This is more than a class system. It’s a full-on CASTE system.

    It’s what happens when you deny a group of people access to daycare, education, jobs, and medical care. Yes, medical care–more and more pediatricians are refusing to accept patients who are not completely caught up on all CDC-recommended vaccines, which include the useless flu shot and Gardasil.

    So a parent in the medical field who chooses to skip the flu shot loses his job. If he even delays a vaccine for his child, the child can’t go to daycare, school, summer camp; even Sunday school and extracurricular activities like sports and arts are starting to demand vaccine compliance.

    So now we have a family who is ostracized from society, AND who may be unable to find a job.

    And then their pediatrician refuses to give the child medical care.

    Our government is willfully creating a caste of “untouchables” for no other reason than for refusing an unnecessary invasive medical procedure.

      People have to stop taking their kids to pediatricians, go to a GP or family practice doctor, or DO, anything but a doggone pediatrician…
